Speaking Up for Justice: The Basics

 

The Speaking up for Justice module (basics and detailed) will enable users to gain a sound basic understanding of the provisions of Part II of the Youth Justice and Criminal Evidence Act, 1999 relating to special measures for vulnerable and intimidated witnesses.

These 'Basics' module provide an overview of the legislation, practice guidance and policy and are supported by the 'more detail' modules also available as part of this training package.

This module forms the pre-course work for the face to face training, and should be completed prior to taking up the classroom training; they can also be used as a stand-alone training package.

Modules

Background to Speaking Up for Justice
Estimated Completion Time: 10 Minutes

This background module on the 'Speaking Up for Justice' report covers the reason why the interdepartmental group that published the report was set up and lists the areas covered by the recommendations of the report.

 

Improving Access to Justice for Vulnerable or Intimidated Witnesses
Estimated Completion Time: 15 Minutes

This module will look at challenges faced by the Criminal Justice System, and those within it, to enable vulnerable and intimidated witnesses to have access to justice.

 

Case Management and Sending Cases
Estimated Completion Time: 10 Minutes

This module covers reviewing cases and conducting trial advocacy involving vulnerable or intimidated witnesses, and outlines which cases can and cannot be transferred from the Magistrates Court to the Crown Court.

 

Competence and Capacity to be Sworn
Estimated Completion Time: 10 Minutes

This module will explain the law in respect of whether a witness is competent to give evidence and capable of being sworn.

 

Identifying Vulnerable and Intimidated Witnesses
Estimated Completion Time: 15 Minutes

This module examines the correct identification of vulnerable and intimidated witnesses.

 

Outline of Legislative Provisions
Estimated Completion Time: 10 Minutes

This module provides a brief overview of the provisions of the Youth Justice and Criminal Evidence Act 1999 relating to vulnerable or intimidated witnesses.

 

Communication with Witnesses
Estimated Completion Time: 10 Minutes

This module introduces the Change Picture Bank and describes the twelve simple steps that aid communication with people with learning disabilities or aural or visual impairments.

 

Legislative and Non-Legislative Measures
Estimated Completion Time: 10 Minutes

This module broadly explains which recommendations in the report have been introduced as legislative measures and which as non-legislative measures. It also outlines the timetable for bringing the legislative measures into force.

 

Other Provisions to Protect Vulnerable or Intimidated Witnesses
Estimated Completion Time: 25 Minutes

This module will introduce the remaining legislative provisions of the Act, including cross-examination of a witness, references to previous sexual behaviour, and reporting restrictions.
