Speaking Up for Justice: In More Detail

 

The Speaking up for Justice module (basics and detailed) will enable users to gain a sound basic understanding of the provisions of Part II of the Youth Justice and Criminal Evidence Act, 1999 relating to special measures for vulnerable and intimidated witnesses.

These 'more detail' modules complement the basic Speaking up for Justice modules and provide more in-depth information about the legislative measures, Speaking up for Justice's non-legislative recommendations, and published practice guidance.

This module forms the pre-course work for the face to face training, and should be completed prior to taking up the classroom training; they can also be used as a stand-alone training package.

Modules

Who is Eligible for Special Measures
Estimated Completion Time: 15 Minutes

In this module you will cover eligibility for Special Measures.

 

Assessing the competence of a witness
Estimated Completion Time: 10 Minutes

This module looks at the rules for judging the competence of a witness. How to determine competence to give evidence and How to assess the competence of a witness to be sworn.

 

Special Measures
Estimated Completion Time: 15 Minutes

This module looks at the special measures available under the Youth Justice and Criminal Measures Act 1999 to ensure that the evidence of a witness is maximised.

 

Protection of a Witness
Estimated Completion Time: 15 Minutes

This module looks in some detail at the protection of a witness. Issues raised include the circumstances under which an unidentified defendant may be prohibited from cross examining, considerations when appointing a representative to cross examine and questions about the sexual behaviour of a complainant.

 

Reporting Restrictions
Estimated Completion Time: 20 Minutes

This module looks in some detail at the reporting restrictions in the Youth Justice and Criminal Evidence Act 1999. These restrictions were largely inspired by recommendations made in the 'Speaking Up For Justice Report'.

 

Guide to Achieving Best Evidence
Estimated Completion Time: 20 Minutes

This module is a guide to 'Achieving Best Evidence in Criminal Proceedings: Guidance for vulnerable witnesses including children.

 

Early Special Measures Meeting
Estimated Completion Time: 20 Minutes

This module looks at Early Special Measures Meetings between the Police and the CPS. Areas covered include a definition of the purpose of the meeting, identifying when a meeting is required, recording that a meeting has taken place and actions that follow the meeting.

 

Making an application for Special Measures
Estimated Completion Time: 20 Minutes

This module instructs on how to make an application for a Special Measures meeting, stressing the importance of making timely and informed decisions about special measures.

 

Meeting Witnessess
Estimated Completion Time: 25 Minutes

The Speaking up For Justice Report Recommends that there should always be a meeting between vulnerable or intimidated witnesses and the prosecutor. This module details how the meeting should be set up.

 

Witness Support and Preparation
Estimated Completion Time: 10 Minutes

This module will help you to understand the importance of effective witness support before during and after the trial. It will help you to understand your responsibility for ensuring arrangements for witness preparation are in place.

 

Pre-Trial Therapy
Estimated Completion Time: 15 Minutes

This module on Pre-Trial Therapy will show you how thinking has changed in the past few years towards vulnerable or intimidated witnesses who are called upon to give evidence.

 

The Trial Process
Estimated Completion Time: 20 Minutes

This module will look at cross examination techniques in obeyance of Speaking Up For Justice report, Interrogation techniques to be avoided, the role and responsibilities of the prosecution advocate in the Farqhuarson guidelines and reference material for further research.

 

Improving Access
Estimated Completion Time: 15 Minutes

This short module will help you to understand the challenge faced by the Criminal Justice System and those within it to help vulnerable and intimidated witnesses have access to justice.
