Fraud

 

This programme of 7 modules introduces everyone involved in casework to the changes in the prosecution of fraud as effected by the provisions of the Fraud Act 2006.

In total it lasts no more than two hours, including a module each on pre course and post course assessment of your knowledge.

Repeals, jurisdiction and, in particular, the newly created offences are examined with special reference to the broader scope of fraudulent acts now captured by the Act. Guidance on the application of the Public Interest criteria is given together with an introduction to the Fraud Prosecution Service.

Modules

Pre-Course Assessment
Estimated Completion Time: 5 Minutes

A pre-course diagnostic assessment consisting of 10 questions. These questions will check your current level of understanding on the topics contained in the programme.

 

Introduction to the Fraud Act 2006
Estimated Completion Time: 20 Minutes

This module introduces the new Act, the reasons for its introduction and details what will be covered in this programme.

 

The three ways of committing Fraud
Estimated Completion Time: 50 Minutes

This module describes the 3 ways an offence of fraud can be committed and identifies the elements for each method. It also looks at the main considerations for charging an offence of fraud and the main considerations for assessing the public interest criterion.

 

Articles for use in Fraud
Estimated Completion Time: 15 Minutes

This module looks at the 2 sections of the Fraud Act which deal with articles used in fraud and the definition of "article" in relation to use in a fraud case. This module also considers the elements of the offence of possession of articles and the offence of making or supplying articles and the penalties for each.

 

Obtaining services dishonestly
Estimated Completion Time: 10 Minutes

This module defines the elements of this offence, the maximum penalty and identifies the main consideration when drafting a charge for this offence.

 

Final considerations
Estimated Completion Time: 10 Minutes

This module covers several remaining areas including the sections of the Fraud Act in relation to participation in fraudulent trading. This module also looks at the work of the Fraud Prosecution Service (FPS).
