Conditional Cautioning Programme

 

This programme, consisting of five modules, aims to prepare Crown Prosecutors for the effective operation of the Conditional Cautioning scheme.

Modules

Module 1 – Introduction and Basic Principles
Estimated Completion Time: 5 Minutes

This module covers the definition of a conditional caution and its purpose, the Director’s Guidance and the Code of Practice. It also reviews the qualifying requirements for, and the key rules relating to, the issue of a conditional caution.

 

Module 2 – Offences and Conditions
Estimated Completion Time: 25 Minutes

This module examines the offences eligible for a conditional caution, how to decide whether such a caution is an appropriate disposal, and the aims / characteristics / types of conditions which may be attached to the caution.

 

Module 3 – Specific Issues
Estimated Completion Time: 5 Minutes

This module explores specific topics, such as: how a formal admission may be recorded, issues raised in drugs cases, calculating compensation, and the principles to apply when an offender has previous convictions or cautions.

 

Module 4 – Compliance
Estimated Completion Time: 5 Minutes

This module contains an overview of the procedure once a conditional caution has been administered, the importance of effective monitoring of compliance, and how to respond to non-compliance.

 

Module 5 – Recording and Review
Estimated Completion Time: 25 Minutes

This module demonstrates how a conditional caution is recorded on Compass. It also tests the learner’s understanding of the topics covered in the programme through a case study and quiz.
